Shipping policy
This Shipping and Transportation Policy governs the organisation and provision of services related to the transportation of vehicles where such services are requested by the Client and arranged by SigmaCars LTD.
1. Organisation of Transportation
Where the Client requests vehicle transportation, SigmaCars arranges and coordinates the transport of the Vehicle from its location to a previously agreed delivery or collection point.
Unless expressly agreed otherwise, the physical transportation of the Vehicle is carried out by an external carrier, transport company, driver or other independent transport or logistics provider selected by SigmaCars.
SigmaCars may select or replace the specific transport provider depending on the route, location and characteristics of the Vehicle, transport availability, timing, price and other relevant circumstances.
Unless expressly agreed otherwise, SigmaCars does not physically perform the transportation itself but arranges its performance through external providers.
2. Transportation Price and Payment
The transportation price is determined individually depending on the specific Vehicle, its location, final destination, route, method of transport and applicable transportation costs.
The Client pays the agreed transportation price to SigmaCars, unless expressly agreed otherwise for a specific case.
After receiving payment, SigmaCars arranges the transportation and makes the necessary payments to the relevant external transport provider.
Payment of the transportation price to SigmaCars does not necessarily mean that SigmaCars physically performs the transportation itself.
Before the transportation is assigned, the Client will be informed of the agreed price or the method by which the price will be determined.
Additional costs arising as a result of a change requested by the Client after transportation has been arranged, including changes to the route, delivery address, date or collection point, may be charged separately after the Client has been informed.
3. Transportation Timeframes
Any transportation timeframe provided is indicative unless a specific delivery date or period has been expressly agreed between the parties.
Transportation may be affected by circumstances outside SigmaCars’ reasonable control, including:
- availability of transport providers;
- route and distance;
- weather conditions;
- road conditions or traffic restrictions;
- actions of customs or public authorities;
- delays in releasing the Vehicle by the Seller;
- breakdown of the transport vehicle;
- technical or logistical difficulties;
- other unforeseen circumstances.
Where SigmaCars becomes aware of a significant delay, the Client will be informed within a reasonable period and provided with the information available at that time regarding the expected completion of transportation.
4. Delivery or Collection Location
The location at which the Vehicle is to be delivered or collected is agreed with the Client in advance.
The Client must provide accurate and up-to-date contact details and delivery or collection information and must ensure that the Vehicle can be received at the agreed place and time.
A change to the delivery or collection location after transportation has been arranged or commenced may result in additional costs and/or a change to the expected timeframe.
5. Vehicle Receipt and Inspection
Upon receiving the Vehicle, the Client should, where reasonably possible, inspect it for visible external damage that may have occurred during transportation.
Where visible transportation damage is identified, the Client should promptly notify both the person delivering the Vehicle and SigmaCars.
Where possible, the damage should be recorded in a handover report, consignment note, CMR document or other applicable transport document and documented with photographs and/or video.
Failure to carry out such an inspection does not in itself deprive the Client of any rights provided by applicable law but may make it more difficult to establish when and how the damage occurred.
6. Transportation Damage and Liability
Where physical transportation is carried out by an external transport provider, that provider is responsible for its own acts and for performance of the transportation service within the limits provided by applicable law and the relevant transport documents and arrangements.
SigmaCars does not guarantee that transportation will be free from incidents, delays, damage or other events caused by an independent external provider or by circumstances outside SigmaCars’ reasonable control.
The use of an external provider does not, however, release SigmaCars from responsibility for its own acts or omissions, failure to perform an obligation expressly undertaken by SigmaCars, or any other responsibility which cannot be excluded under applicable law.
Where transportation damage is identified or suspected, SigmaCars may assist with establishing the relevant circumstances, communicating with the transport provider and providing available documentation required for the matter to be reviewed.
7. Condition of the Vehicle
The arrangement or performance of transportation does not constitute a guarantee by SigmaCars regarding the Vehicle’s:
- technical condition;
- history;
- mileage;
- equipment;
- previous repairs;
- other characteristics.
Damage, defects, signs of use or other conditions that existed before the Vehicle was handed over for transportation do not constitute transportation damage.
Responsibility for the Vehicle’s conformity with the terms of its purchase agreement is determined by the relationship between the Client and the relevant Seller and by applicable law.
8. Inability to Perform Transportation
Where transportation cannot be performed due to circumstances relating to the Vehicle, Seller, Client, transport provider or another circumstance outside SigmaCars’ reasonable control, the Client will be informed as soon as reasonably possible.
Depending on the circumstances, another transport provider, route, timeframe or other suitable solution may be arranged.
Where actual and non-refundable costs have already been incurred in connection with organising or performing the transportation, their refund or retention will be determined according to the reason for the cancellation, the costs actually incurred, the agreement with the Client and applicable law.
9. Cancellation or Modification of Transportation
The Client should inform SigmaCars as early as possible if they wish to cancel or modify requested transportation.
Once transportation has already been assigned to an external provider, actual costs may arise, including costs relating to:
- cancellation;
- waiting time;
- route changes;
- empty mileage;
- other costs directly connected with the requested change.
Where the Client qualifies as a Consumer, this provision does not restrict any rights that cannot lawfully be excluded or limited under applicable consumer protection law.
10. Relationship with the Terms of Service
This Shipping and Transportation Policy applies together with the Terms of Service and the other applicable SigmaCars policies.
Where these terms conflict with individually agreed written terms for a particular transportation service, the individually agreed terms will prevail for that specific service, provided that they do not conflict with mandatory provisions of applicable law.
